BOARD OF SELECTMEN/BOARD OF HEALTH

At 11:00 am Duane Mosier arrived for the posted meeting and continued the meeting to 1:00 pm. 

 

At 1:00 pm the meeting was called reconvened. 

 

Members Present:  Duane Mosier, James Smith

 

Guests: Stan Weinberg, Labor Counsel.

 

At 1:05 pm James Smith made a motion to go into Executive Session for the purpose of negotiations with the IBPO representing the Police Officers, and to discuss potential litigation and to continue the meeting in Open Session following the Executive Session.  Duane Mosier seconded.  Role call vote:  Duane Mosier – Yes, James Smith – Yes.

 

At 2:20 pm the Board returned from Executive Session and took a 15-minute break.

 

October 25th Special Town Meeting

 

Upon return from the break the Board reviewed the details of the monetary items for the upcoming October 25th Special Town Meeting.

 

Conservation Commission

 

James Smith presented a summary of the October 12th meeting he attended with the Conservation Commission and the issues surrounding the Scantic Grille Title V permit that had occurred prior to the Conservation Commission meeting.  Mr. Smith was extremely concerned about the actions of the Conservation Commission that appeared to supersede their authority and that appeared to be in conflict with the Wetlands Protection Act and the Town of Hampden’s Wetlands Bylaws.  Mr. Smith was also concerned that the Conservation Commission was circumventing public notification requirements for a Notice of Intent based on the Conservation Commission’s determination that the system repair was necessary for a public health emergency – even though the Board of Health had not declared such an emergency.

 

 Mr. Smith said he would seek a legal opinion from Town Counsel to see if the Commission had indeed exceeded their authority.  Mr. Smith said he would submit a written summary at the regularly scheduled October 19th meeting of the Board of Selectmen. 

 

Personnel – Goals and Objectives

 

The Board discussed the upcoming goals and objectives reviews for the Administrative Assistant and the Board of Health Coordinator to be held on October 19th.

 

 

At 3:10 pm Douglas Farmer, reporter for the Wilbraham-Hampden Times arrived.  Mr. Farmer asked about October 12th meeting with the Conservation Commission that he was unable to attend.  Mr. Farmer stated that he had already had similar discussions with Michael Gerrard, Chairman of the Conservation Commission.

 

The Board continued discussion on the upcoming goals and objectives for the Administrative Assistant and the Board of Health Coordinator.

 

The meeting was adjourned at 3:30 pm.
